According to the Explanatory note, the aim of an electoral threshold is a legal guarantee for the stable functioning of the democratic system. For the Venice Commission, taken separately, the 5% threshold is not to be criticised: such barriers are common in many European states.  By keeping out small parties, electoral thresholds aim at avoiding fragmentation, thus rendering the political system more stable and facilitating the formation of a government majority.
