Greater clarity of regulation could safeguard observers’ rights. The draft code lists the right of proxies and observers to be present in the voting room during the entire voting process, but does not mention the right of observers to be present during the counting of ballots and tabulation of results (in contrast with proxies in Article 34.1(7)). Article 68.2, providing that all persons with the right to attend the commission meeting are allowed to be present during the count, means that observers are not excluded. However, it would be suitable that the right to observe the counting and tabulation of results be listed explicitly. Observers could also be included in Article 67.14.
