The Venice Commission has always recognised a general competence in electoral matters to the State of BiH, since this stems from Annex 3 to the General Framework Agreement for Peace. However, the Venice Commission also admitted some limited intervention by the Entities, as long as basic principles laid down by federal law were heeded. This delegation should not in itself be interpreted as allowing the State to go against an Entity’s constitution and organisational autonomy.
