Paragraph 51

The fact that the Constitution of the Kyrgyz Republic does not establish a specialised constitutional court but rather a Constitutional Chamber of the Supreme Court has important repercussions on the appointment of the judges of the Chamber. Article 97 par 11 of the Constitution in force provides that the composition of the Chamber shall be defined in a constitutional law. Article 5 par 2 of the Constitutional Law on the Constitutional Chamber of the Supreme Court in turn provides that the judges of the Constitutional Chamber shall be elected pursuant to the procedure envisaged in the Constitutional Law on the Status of Judges. As a consequence, the judges of the Constitutional Chamber are appointed in the same manner as ordinary judges and following the same principles.
