Hence, while a supreme judicial body such as the Supreme Court generally plays a key role in a country, by, among others, providing legal certainty, foreseeability, and uniformity in the interpretation and application of laws, it should not supervise lower courts nor issue guidelines, directives, explanations, or resolutions that would be binding on judges. Article 96 par 2, as amended, allowing the Supreme Court to give mandatory “explanations” should, therefore, be deleted.
