Pursuant to the new Article 95 par 6, the transfer and rotation of judges of local courts shall be undertaken by the President upon submission of the Council of Judges in accordance with the procedures and cases laid down in the constitutional law. It is not clear to what extent the decision of the Council of Judges is binding on the President and it is not possible to rule out a situation where the President would not follow the submission of the Council of Judges, thereby undermining the authority and the independence of this self-regulatory body. It would, therefore, be advisable to omit the involvement of the President in such internal matters of the judiciary.
