The revised Article 68 par 2 of the Constitution states that officials exercising the powers of the President in case of early termination of his/her mandate and pending the organization of early presidential elections (Article 68 par 1) may not run for the office of president in such elections. This constitutes a restriction of the right of any person to stand for election, as guaranteed by Article 25 (b) of the ICCPR. Any restrictions on the right to stand for election must be justifiable based on objective and reasonable criteria to be laid down by law. As such criteria are not apparent in this case, the drafters are encouraged to delete this limitation from Article 68 par 2 of the Constitution.
