Further, it appears that such dismissals would be automatic, without due consideration of each individual case. General Comment No. 32 of the UN Human Rights Committee on Article 14 of the ICCPR emphasizes the importance for states to ensure that “[j]udges may be dismissed only on serious grounds of misconduct or incompetence, in accordance with fair procedures ensuring objectivity and impartiality set out in the constitution or the law”.


Moreover, a judge should in principle be entitled to appeal the decisions relating to his/her early dismissal.
