In addition, it is of some concern that the draft law has removed the sanction of a formal notice issued to the party at fault. Having regard to the principle of proportionality, the Venice Commission has previously recommended that less severe sanctions such as warnings or small fines would be more appropriate before imposing the most severe sanctions, and that in any case, even before the issuing of a warning, the association “should be offered the possibility to seek clarifications about the alleged violation”, and that the possibility to correct errors should be provided for. It is recommended that the draft law be supplemented to this effect, at least with regard to less serious breaches. In addition, more generally, it is recommended that the draft law specify that all the provisions of Chapter V on sanctions should be applied in accordance with the principle of proportionality.
