With regard to the sanctions available for violations of the rules, the Venice Commission welcomes the significant overhaul of the existing regime, which introduces, among other things, fines of different levels, according to the gravity of the offence, and the sanction of withholding public funding for certain offences. It is also important that the draft law no longer provides for the suspension of the political party’s activities and that it reduces the list of offences that can be sanctioned by dissolution of the party. However, it is worrying that this latter sanction is still in place for offences related to the financing of the party (such as the failure to publish its financial reports); having regard to international standards in this field, such a measure must remain exceptional and can be justified only in cases where the party advocates the use of violence or uses it as a political tool to overthrow the democratic constitutional order.
