Article 42
 

Article 42 The Second Ballot               (1)       Where none of the candidates received absolute majority of valid votes in the first ballot, the second ballot shall be held within 14 days. The Chairman of the National Council of the Slovak Republic shall announce the second ballot and its date immediately after publication of the election returns by the Central Election Commission.               (2)       The two candidates who received the highest number of valid votes in the first ballot shall stand at the second ballot. Where one of the candidates at the second ballot disqualifies as a candidate for Chairman, or if he renounces his candidacy, the candidate with the third highest number of votes in the first ballot shall replace him. Where there are  two candidates not available for the second ballot, the new election shall be held under Article 46 (1)(d).               (3)       The second ballot shall be held pursuant to Articles 17 and 21, 22, 25, 26, 28 to 40, and Articles 23 and 27 shall apply accordingly.               (4)       In the second ballot the candidate who received the highest number of votes is elected the Head. Where there is a tie between two candidates the new elections shall be held under Article 46 (1)(d).
