When special constituencies are created for citizens abroad, states should be given a broad margin of appreciation concerning their design and the allocation of seats. This is justified by the difficulty to quantify the number of citizens abroad as well as the limited links or disinterest in political life of a number of residents abroad. Moreover, basing the number of seats on the number of registered voters in a system of active registration could be misleading, since practical hurdles could prevent a number of people to register and/or to vote and then lead to a very low turnout.
