The Venice Commission cannot examine or determine this question of fact, but it can explore the question of emergency situations in legal terms given that, without referring to this type of specific danger, the Reasoning of Decree no. 11199 does refer to the “risk of a civil conflict” as well as a danger to the “stability to public order, which could also be a threat to the national security”. Admitting, for the sake of argument, that there might have been such a danger, the question is therefore who is entitled to take such a decision according to the national constitution?
