In relation to the citizenship of another state, ODIHR and Venice Commission note the prohibition for citizens of the Kyrgyz Republic who have another citizenship to hold state political and judicial offices, according to Article 52.2 of the Constitution. It should be pointed out, however, that this restriction diverges from the practice of Council of Europe member states. The European Convention on Nationality, ratified by 21 countries, provides in Article 17 that:
“Nationals of a State Party in possession of another nationality shall have, in the territory of that State Party in which they reside, the same rights and duties as other nationals of that State Party”.
