It is true that term limits may inhibit voters from choosing the incumbent or former president as a new president. However, the right to vote presupposes passive electoral rights, and limitations on passive electoral rights obviously also restrict active electoral rights. As argued above, limits on re-election pursue the aim of preserving democracy. They contribute to guaranteeing that periodic election are “genuine” in the sense of Article 25 ICCPR and Art. 23(1b) ACHR.
