Paragraph 75

A clear distinction has to be made between recall of members of legislative or deliberative assemblies (bodies exercising representative democracy, such as a parliament or a municipal council), on the one side and recall of elected members of the executive on the other side - in the vast majority of cases a president or a mayor. As already said, the principle of the prohibition of the imperative mandate applies to individual members of elected assemblies, and not to executive positions.
