In this provision, assets and human resources are considered as administrative resources as soon as they are used for electoral purposes during working hours. This provision is interesting as it covers at least in the law the requirements for preventing misuse of administrative resources. Nevertheless, the last joint opinion of the Venice Commission and the OSCE/ODIHR on the Electoral Code of Albania underlines that the expression “with the exception of motivated cases” (Article 88.2) “appears as very broad and needs some specification”. Therefore, “the Venice Commission and OSCE/ODIHR recommend amending Article 88.2 in order to limit the scope of this exception”.
