Given the preceding paragraphs, the Venice Commission is of the view that it should be made clear in the law that ineligibility of an election candidate on the grounds of prohibition from public service requires a final individual criminal conviction by a court for a serious offence as well as an express decision on the candidate’s ineligibility prior to the elections.
