On April 26, 2018, the Constitutional Court of Ukraine declared the Law of Ukraine No. 5475-VI unconstitutional. The Court concluded that the Law was not in line with the constitutional principle of national sovereignty since it created mechanisms for the people to exercise power directly and bypass the Parliament, thus ignoring the constitutional principle of “division of state power”. The Court also established that the law had been adopted in violation of the constitutional requirement for personal voting by People's Deputies. The Constitutional Court noted that the draft law on the all-Ukrainian referendum had not been considered at a session of the relevant Committee of the Verkhovna Rada and had not been discussed at the plenary session of the Verkhovna Rada before it was adopted.
