The draft Law adds a new definition to Article 1 of the Electoral Code: an “appellant” is defined as an electoral law subject who seeks to restore his/her rights violated by electoral bodies or electoral contenders. This definition appears to be unduly narrow, potentially limiting rights of certain categories of electoral stakeholders to appeal if they cannot prove their individual rights were violated. The Electoral Code provides for the possibility to “challenge the decisions of the electoral bodies and the decisions of the Audiovisual Council with respect to the appeals… in the competent court” (Article 71.3). Electoral rights may also be violated by persons other than electoral bodies or election contenders, e.g. by state officials or third parties. It is recommended that the definition of an “appellant” is revised to include all complainants who allege violations of electoral legislation. Similarly, the definition of a “complaint” should be revised to also reflect complaints against the media, state officials and third parties.
