The rights arising from Article 3 of Protocol 1are not absolute, since they are subject to implicit limitations. The contracting States enjoy a wide margin of discretion in deciding the conditions for universal suffrage and the electoral system. However, these conditions and limitations should serve a legitimate purpose and should not be disproportionate (ECtHR, judgment of 2 March 1987, Mathieu-Mohin and Clerfayt, series A 113, § 52).
