With regard to remote voting, there is considerable diversity in the legal systems of the Council of Europe’s member States. Of the 30 legal systems analysed, however, 19 provided for remote voting by post in some way or another. Although in the majority of those countries postal voting is only available to electors who are out of the country on the election date, it is generally accepted in these countries either that there is compatibility with the principle of secret suffrage or, in the event of interference with this principle, that there is at least compatibility with Article 3 of Protocol 1. In this respect, it is of little consequence that five countries allow postal voting without restriction even within the national territory.
