The constitutional grounds are established by the Amendment 6 of the Constitution. This amendment introduced the concept of "appropriate and equitable participation of communities (i.e. national minorities) in the state organs and the public institutions at all levels" as one of the fundamental values of the constitutional order of the Republic.
