The legality of internet shutdowns is not often tested in courts. The ECtHR in cases concerning the blocking of access to the internet held that there has been violation of Article 10 of the ECHR when the measure in question produced arbitrary effects and the judicial review of the blocking of access had been insufficient to prevent abuses.
