Even recent reforms may not go far enough: While in the Republic of Moldova the Constitutional Court declared the blanket denial of voting rights of persons declared incompetent by a court unconstitutional (2018), a court can still deprive a person of the right to vote on the basis of mental disability. In Denmark, newly adopted provisions (2018) allow for the reinstatement of voting rights for some individuals under guardianship. However, the legislation still includes provisions that deprive persons considered to be fully incapacitated from their voting rights, according to ODIHR.
