According to the ECHR, the democratic state order may be protected against individuals who are not ethically qualified to become representatives of a democratic state at a political or administrative level. In order to determine whether restrictions on passive electoral rights are proportionate, however, it is necessary to assess very carefully whether the person poses a real threat to the democratic order, the national security or the state’s integrity.
