In Belgium, there is no constitutional or even legislative basis for a referendum and a decision-making (legally binding) referendum is considered unconstitutional. A consultative referendum – the constitutionality of which has been strongly disputed – was organised in 1950 further to a specific decision of Parliament. The fact that the constitution does not mention referendums could accordingly be regarded as ruling out a referendum.
