Most of the replies to the questionnaire state that, generally speaking, it is not so much the legal nature of the act that determines whether or not it can be submitted to local or regional referendum; rather, the decisive factor is whether or not the act comes within the remit of local or regional authorities. This is the case in the following states: Albania, Armenia, Belgium, Bulgaria, Croatia, Finland, France (in respect of local referendums), Hungary, the Netherlands, Portugal, Russia, Sweden and “the former Yugoslav Republic of Macedonia”). In other words, this means that, in these states, all acts of local or regional authorities can theoretically be submitted to referendum. Denmark, Estonia, Luxembourg and Poland do not have any specific rules, from which it may be inferred that a similar situation exists.
