Under the present legislation and since 2017, parties with parliamentary factions have the right to appoint election commission members at all levels in proportion to the number of votes received in the last parliamentary elections. The ODIHR observed in recent elections that this resulted in dominant representation of the ruling party in the election commissions which negatively impacted public perception of the impartiality and independence of the commissions, a cornerstone of any election administration. The move from multiple (proportional) to single appointments to the CEC by each eligible party addresses an ODIHR recommendation following the 2020 parliamentary elections that states: “The composition of the election administration could be reconsidered to increase its impartiality and independence. The appointment formula could be revised to ensure more balanced political representation and to prevent factual dominance of a single political party.”
