As foreseen by the Constitution, the draft law regulates different types of referendums, in different provisions (Articles 2, 9, 10, 11, 13, 43, 44, 46, 47, 48, 49, 50, 52…). The constitutional provisions on referendums (in particular Articles 108, 182 and 203) are not restated or referred to in the draft law. The Serbian authorities informed the Commission that, under the Serbian rules on drafting legal acts, it is a rule not to take over the provisions or regulations that occupy a higher place in the hierarchy of legal acts This however makes the categorisation of referendums rather difficult to understand.
