Temporary procedure for the participation of a wheelchair user voter in the 2021 elections of the municipality bodies
1. A wheelchair user voter may participate in the 2021 elections of the municipality bodies at any adapted electoral precinct within the territory of a respective local majoritarian electoral district, for which purpose, he/she must apply to a respective DEC or PEC not later than the 6th day before the polling day. For a voter to change an electoral precinct:
a) the secretary of a DEC/PEC shall register a written application (the application must include the personal number of a Georgian citizen) or a verbal application of a voter received by a telephone message (in such a case, the personal number of the voter, exact time of the telephone message and the telephone number shall be indicated) in a registration log book and shall certify it by the signature;
b) if a voter applies to a DEC, a respective PEC shall be informed of the entry of a voter registered in the list of voters of this electoral precinct into the special list of voters of an adapted electoral precinct. If a voter applies to a PEC, the PEC shall, not later than the 6th day before the polling day, transfer information about this voter to the respective DEC;
c) it shall be specified in the unified list of voters that a voter has been moved to the special list of voters of an adapted electoral precinct within the territory of a local majoritarian electoral district, and a text ‘a wheelchair user’ shall be written in the box of ‘Factual Status’ in the unified list of voters and the special list of voters, which is certified by the signatures of the Chairperson of a PEC and the Secretary of the same PEC.
2. Members of a PEC, representatives of an electoral subject and observers shall have the right to verify the reasonableness of a request that the wheelchair user voters vote at an adapted electoral precinct and, at any time before Election Day, to raise an issue before a PEC regarding the appropriateness of entry of these voters into the relevant special list. A DEC shall make the decision on the above issue within a period of time set by this article, on the basis of information provided by the PEC.
3. The DEC shall, on the basis of the information received from the PECs and of its own data, not later than the 3rd day before the polling day, compile and approve, by an ordinance, the special list of voters of the adapted electoral precincts, and shall immediately forward to the respective PEC a version of this list intended for public information and signed by the Chairperson and the Secretary of this PEC, and not later than 12 hours before polling, the DEC shall forward the version intended for an election commission.
4. The special list of voters of an adapted electoral precinct shall include the same data of a voter as are included in the unified list of voters, and a sequence number of this voter in the unified list of voters shall additionally be indicated in the special list of voters.
5. The version of the special list of voters of an adapted electoral precinct (without photos), intended for public information, which is forwarded by a DEC to a PEC, shall immediately be posted at a visible place in the PEC building (polling station).
6. The state authorities, municipal bodies, legal entities under public law (except for membership-based and religious associations) and organisations established with more than 50% participation interest of the state and municipal bodies shall communicate information about the adapted electoral precincts to the election administration of Georgia before 1 September 2021.
