Article 5
 

(1) Community voter shall refer to any citizen of a Member State of the European Union, other than Romania, who is entitled to vote in Romania in the elections to the European Parliament, having his/her domicile or residence in Romania, in accordance with the provisions of this law.


(2) National voter shall refer to any citizen of Romania having his/her domicile or residence in Romania or abroad, who is entitled to elect members from Romania to the European Parliament, in accordance with the provisions of this law.


(3) Community eligible person shall refer to any citizen of a Member State of the European Union who is entitled to be elected to the European Parliament, having his/her domicile or residence in Romania, in accordance with the provisions of this law.


(4) Within the meaning of this law, reference date shall mean the day of elections for the members from Romania to the European Parliament.


(5) Romanian citizens who turned 18 by the reference date inclusive areentitled to elect members from Romania to the European Parliament.


(6) The mentally retarded persons and the certified lunatics deprived of legalcapacity, as well as the persons who, on the reference date, are sentenced by final judgement to the loss of their electoral rights shall not be entitled to vote.


(7) Romanian citizens who are entitled to vote and have turned 23 until thereference date inclusive are entitled to stand as candidates to the European Parliament.


(8) The provisions of paragraphs (5)–(7) shall apply as well to the Romaniancitizens having their domicile or residence abroad and who have the right to vote in accordance with the provisions of this law.


(9) The citizens of the Member States of the European Union, within themeaning of Article 17 (1) in the Treaty for the establishment of the European Community, with the subsequent amendments and completions, who have their domicile or residence in Romania, have the right to vote and to be elected as members from Romania to the European Parliament, under the same conditions as the Romanian citizens, provided that they meet the requirements of this law.


(10) For the election of the members from Romania to the EuropeanParliament, both the national voter and the community voter are entitled to only one vote.
