The draft Code does not elaborate on the specific mechanisms for forming and updating the lists of voters residing abroad. According to Article 39(5), the CEC approves the rules on establishing the polling stations abroad, and, additionally, according to Article 61(6), the CEC will develop the procedure on the voter lists for voters abroad. The lack of express rules does not guarantee legal certainty and is problematic given a generally high number of citizens voting from abroad. Given the importance and the political sensitivity of the vote abroad, to increase its overall transparency, the Code could include a requirement for the CEC to maintain and periodically update and publish the relevant information related to voting abroad. In addition, the key aspects of voter registration of those residing abroad could be incorporated into the law rather than left to administrative regulations.
