According to Article 95(1), the calculation of deadlines for lodging appeals is linked to the day the action was committed, rather than the day an applicant became aware of the action committed, in all cases in which the applicant can demonstrate that it is not reasonable to expect beknowing the action when committed. Since Article 96 establishes an applicant's responsibility for timely application submission, ODIHR and the Venice Commission recommend to link the calculation of deadlines with the moment when the action in question became known or should have become known to the applicant.
