More generally, given the credible reports on the misuse of administrative resources in Serbia, the Venice Commission and ODIHR recommend that a legislative framework be reviewed and improved to ensure a level playing field for candidates. This framework should follow the principles in the Joint Guidelines on administrative resources, respecting the rule of law, political freedoms, impartiality, neutrality, transparency, and equality of opportunity. Rules should also take a broad definition of the electoral process, covering a period much longer than the electoral campaign as strictly understood in national electoral law. The law should establish dissuasive sanctions for the misuse of office and administrative resources. Thorough implementation and enforcement practices should be ensured.
