So-called “overhang (surplus) mandates” were allocated if a party won more direct mandates through first votes (majoritarian) in a federal state than it would be entitled to according to the second vote (proportional) results in the respective federal state. In addition, on the basis of the case-law of the Constitutional Court, additional compensatory mandates had to be allocated to ensure proportional results (see below).
