Up to the latest amendments, the German Federal Election Act stipulated an exemption to the 5% threshold for parties having obtained (at least) 3 direct mandates in constituencies (Grundmandatsklausel) – as well as for parties representing national minorities (Danes, Frisians, Sorbs and Roma).
