Similarly, the alternative draft’s ban for the elected officials of the prohibited parties to enter public service (category “A” positions), without individual assessment of the behaviours of the said persons would appear disproportionate. UN Human Rights Committee’s General Comment 25 stresses that “the conditions for access to public service positions, (…) restrictions which apply and the processes for appointment, promotion, suspension and dismissal or removal from office as well as the judicial or other review mechanisms which apply to these processes” must be clearly defined.65 In any case, as per the general principle laid down in General comment 25 “any restrictions must be objective, reasonable, and non-discriminatory”.
