By letter of 24 July 2023, Mr Igor Grosu, Speaker of the Parliament of the Republic of Moldova, submitted a request for an opinion of the Venice Commission on the Law on the amendment of certain normative acts (the implementation of certain considerations of the Decision of the Constitutional Court no. 10/2023 on the check of the constitutionality of the Political Party ‘Șor’). As this Opinion relates to the electoral field, it was prepared jointly by the Venice Commission and ODIHR. The provisions on the ineligibility to be elected addressed in this Joint Opinion were declared unconstitutional by the Constitutional Court on 3 October 2023. On 4 October 2023, the Parliament of the Republic of Moldova adopted a new Article 16(2)(f) of the Electoral Code which provides for new causes for ineligibility to be elected. The Venice Commission and ODIHR are not in a position to analyse these amendments in the present Opinion.
