In light of the foregoing, it may be acceptable to introduce a mechanism of disqualification to stand for election whereby the competent authorities or courts will merely verify whether a particular individual belongs to the category or group fulfilling the conditions of Article 16(2)(f), providing that the said individual is genuinely able to challenge the existence of such conditions in the first place. This may be preferable to empowering the authorities to investigate if these individuals had tried to determine the party to quit the actions that led it to be declared unconstitutional or they had dissociated publicly from these actions, which could be very intrusive.
