A number of elements of the amendments have to be welcomed:
- The limitation of the duration of the ineligibility to three years from the decision on unconstitutionality of the political party, instead of five, which should limit the risk of sanctions disproportionate in time;
- The introduction of a more individualised approach applying the sanction of ineligibility on the basis of specific individual behaviour of its addressees and ultimately narrowing the application of the restrictions to a much smaller group of persons;
- The introduction of the opportune ity to seek judicial review of the decision of deprivation of the right to stand for election, as well as an opportunity to present evidence to the electoral bodies to dispute the determination about their activities.
