The legality requirement demands that disqualification from office be based on clear norms of law.11 The Court of First instance found the mayor guilty of administrative offences under Article 172(1) and (2) of the Ukrainian Code of administrative offences. Article 24 of the Code of Ukraine on Administrative offences reads: “the following administrative penalties may be applied for committing an administrative offence <…> deprivation of the right to hold certain positions or to be engaged in certain activities”. The additional sanction is therefore prescribed in the law. While there is no express mention of the position of mayor, this provision appears sufficiently clear to allow for depriving mayors of their position.
