Like Article 3 of Protocol No. 1 to the ECHR, Article 25 ICCPR does not contain a list of “legitimate aims” capable of justifying restrictions on the exercise of the rights it guarantees. To be legitimate, the aim the restriction pursues must be compatible with the principle of the rule of law and the general objectives of the treaty. Article 25 ICCPR provides that the right to take part in public affairs, including the right to be elected, shall not be subject to “unreasonable restrictions”, and any limitation must be justifiable on objective and reasonable criteria.
