The question arises therefore whether the nature of the offence or of the sanction can be considered as serious enough to lead to disqualification. In the present case, the Venice Commission notes that the primary sanction itself (an administrative fine of about 176 €) is not a very heavy one. It belongs to the Constitutional Court to assess whether the nature of the offence which led to a rather light administrative fine can be considered as serious enough to also lead to the additional sanction of disqualification, and therefore to conclude whether or not the law, as applied in the instant case, strikes a fair balance between the legitimate aim pursued (see paras 24-26 above) and the protection of the right to sit as an elected person.
