Article 213 b
 

Art. 213b. (New - SG 104/22) (1) (Declared unconstitutional in the part "received more than four percent of the actual votes in the last parliamentary elections held" by Constitutional Court Decision № 9 of 2023 - SG 104 of 2023) The Central Election Commission, assisted by the Minister of Electronic Governance, shall provide access to the source code and documentation of the system for the electronic machine voting, as well as all other software tools applicable in the electoral process, to persons named by the parties and coalitions that received more than four percent of the actual votes in the last parliamentary elections held. Each of the parties and coalitions can nominate no more than three persons.


(2) The Central Election Commission may not impose restrictions on the persons under Para. 1 based on educational criteria. 10 days prior to the election day, access under Para. 1 shall not be granted.


(3) The Central Election Commission shall prepare and publish a plan for holding elections using machine voting. The plan shall describe all the actions and security measures taken by the participants in the process of securing the machine voting, including:


1. managing the cryptographic keys;


2. creating and installing on the technical devices for machine voting of system and application software;


3. loading data for the relevant elections in the technical devices for machine voting;


4. storing and transporting the technical devices for machine voting.


(4) When conducting elections, the Central Election Commission shall perform the following actions up to 24 hours before election day:


1. organize a sample check of the cryptographic identifiers of the electronic machine voting system under Art. 218, Para. 7 in the presence of registered observers and representatives of the parties and coalitions that received more than four percent of the actual votes in the last parliamentary elections held;


2. organize a sample check of the database with authorized sources in the security module of the launch of the operating system of the technical device for machine voting in the presence of registered observers and representatives of the parties and coalitions that received more than four percent of the actual votes in the last parliamentary elections held elections;


3. publish all cryptographic identifiers resulting from the process of building the machine voting software, including the source code and the built software components;


4. publish all public cryptographic keys assigned to the sectional committees before election day.
