Types of Local Elections and the Procedure for Their Calling
1. The local elections may be regular, extraordinary, repeat, by-election, supplementary elections, or the first elections.
2. Regular local elections shall be called in connection with the expiration of the term of office of local councils, village and settlement mayors elected in the previous regular local elections.
Regular local elections are held simultaneously throughout Ukraine on the last Sunday of October of the fifth year of the term of office of the councils and mayors elected in the previous regular local elections.
Regular elections of rayons in the city councils (in case they are created) shall be held simultaneously with other regular elections on the entire territory of Ukraine within the time limits and in accordance with the provisions of this Code.
The decision to call regular elections of members of oblast, rayon, city, rayon in cities, village, settlement councils, village, settlement, city mayors shall be made by the Verkhovna Rada of Ukraine.
The decision to call regular elections of members of the Verkhovna Rada of the Autonomous Republic of Crimea shall be made by the Verkhovna Rada of the Autonomous Republic of Crimea in accordance with the Constitution of Ukraine.
3. Extraordinary local elections shall be called by the Verkhovna Rada of Ukraine in case of early termination of powers of the Verkhovna Rada of the Autonomous Republic of Crimea, oblast, rayon, city, rayon in the city, village, settlement council, village, settlement, city mayor, as well as in other cases provided by law. Such a decision shall be made by the Verkhovna Rada of Ukraine no later than within ninety days from the date of early termination of the powers of the Verkhovna Rada of the Autonomous Republic of Crimea, the relevant local council, village, settlement, city mayor.
4. Repeat local elections shall be appointed by the territorial election commission in case the relevant local elections are recognized as not having taken place, in accordance with the procedure established by this Code.
The grounds for recognizing local elections as not having taken place and calling repeat elections are defined in Article 280 of this Code.
5. By-elections of members (a member) of a village, settlement, city council (a territorial community with up to 10,000 voters) shall be called in the relevant multi-member constituency in connection with the early termination of the powers of the member of the relevant council elected in that constituency. When calling the elections, the territorial election commission shall determine the number of seats that will be distributed in such elections in a multi-member constituency.
6. Supplementary elections of members of village and settlement councils from a territorial community that has joined another territorial community shall be appointed by the Central Election Commission in accordance with the procedure established by this Code.
Members of village and settlement councils elected during supplementary elections shall exercise their powers until the election of a new composition of the relevant council at the next regular or extraordinary local elections in accordance with the procedure established by the Constitution of Ukraine, this Code, and laws of Ukraine.
7. The first elections of members of village, settlement, city councils, village, settlements, city mayors shall be appointed by the Central Election Commission upon the relevant request of the authorized body.
The first elections of members of oblast and rayon councils shall be appointed by the Central Election Commission upon the relevant request of the authorized body on the basis of a decision on the formation of oblast and rayon councils,
The first elections of members of rayon in the city councils (in case they are created) are appointed by the corresponding city council based on the decision on the formation of rayon councils in the city.
8. In the year of the regular local elections, by-elections shall not be called and shall not be held, and the first local elections shall be called and held together with the regular local elections.
9. The Central Executive Body, which ensures the formation and implementation of state regional policy, state policy in the field of local self-government development, territorial organization of power and administrative-territorial structure, shall provide the Central Election Commission no later than one hundred and ten days before the day of voting according to the form established by the Commission the information on the list of local councils with the indication of the administrative-territorial units which are a part of them, in each area of Ukraine, and also in the Autonomous Republic of Crimea.
