Territorial Organization of Elections of Members of Oblast, Rayon, Rayon in the City, City, Village, Settlement Councils (territorial communities with 10,000 or more voters)

1. A system of the territorial organization of elections of members of the oblast, rayon, rayon in the city, city, village, settlement councils (territorial communities with 10,000 or more voters) consists of:

1) a single multi-member election district;

2) territorial election districts;

3) election precincts.

2. A single multi-member district shall include the territory of the respective oblast, rayon, rayon in the city, city, village, or settlement.

3. Territorial election districts in elections of members of the oblast, rayon, rayon in the city, city, village, settlement councils (territorial communities with 10,000 or more voters) shall be established by the respective oblast, rayon, rayon in the city, city, village, settlement election commission no later than the second day of the election process, in compliance with the principle of continuity of boundaries (adjacency of territories) of such districts. The respective election commission shall, while making the above decision, assign numbers to multi-member election districts.

4. A tentative number of territorial districts, specified in Part three of this Article, shall be established as a quotient obtained as a result of the division of the quantitative composition of the respective council by 10. When establishing such districts, the deviation from their tentative average number shall be no more than two districts.

5. When forming territorial constituencies for the election of members of the city council of a city with a rayon division, territorial constituencies shall be formed, if possible, within the limits of the respective districts in the city.

The boundaries of a territorial district formed in a city with a district division may not include parts of the territories of different districts in the city.

Within the rayon, more than one territorial district may be formed in the city.

The boundaries of a territorial district for the election of members of the city council of a city with a rayon division may include several adjacent rayons in the city.

6. In the formation of territorial constituencies for the election of members of the oblast council, such constituencies shall be formed, if possible, within the relevant rayons, cities of oblast significance that are part of the region.

Such constituencies may not consist of parts of territories of different rayons, cities of oblast significance, rayons and parts of city or part of rayon and city of regional significance, except for cases when territorial constituencies are formed within an amalgamated territorial community, which includes territorial communities of adjacent rayons, adjacent rayon, and cities of oblast significance. More than one territorial constituency may be formed on the territory of a city of oblast significance, rayon.

The boundaries of a territorial district for the election of members of an oblast council may include several adjacent rayons and cities of oblast significance.

7. The main election commission shall publish a decision on establishing multi-member election districts, with an indication of the number of each such district, no later than on the day following the establishment thereof.
