A Decision of a Territorial Election Commission Based on Voting Results in Elections of a Village, Settlement or City Mayor


1. A village, settlement, city election commission based on the protocol on the results of the voting in the elections of the village, settlement, the city mayor shall make one of the following decisions:


1) to recognize a person elected as a village, settlement, city mayor;


2) to appoint repeat voting for the election of the village, settlement, city mayor;


3) to recognize the election of the village, settlement, city mayor as not having taken place, and to appoint repeated elections because of this.


2. The territorial election commission for the respective elections recognizes as elected village, town, city chair (city with up to 75 thousand people) the candidate who received the highest number of votes compared to other candidates.


3. The city (city with 75,000 voters or more) territorial election commission based on the results of voting on election day recognizes as elected mayor the candidate supported by more than half of the votes of voters who took part in the voting.


4. If, as a result of voting on election day, two or more candidates received the largest and at the same time the same number of votes, the territorial election commission shall decide to call a repeat voting for these candidates.


5. If only one candidate was included in the ballot paper for the election of a village, settlement or city mayor, he/she should be considered elected if the number of votes cast for him /her exceeds 50 percent of the number of voters who took part in the voting.


6. The city (city with 75,000 voters or more) territorial election commission decides to hold a repeat voting if more than two mayoral candidates were included in the ballot for the mayoral election, and none of the candidates received more than half of the votes cast on the election day.


7. If there are grounds specified in Article 280 of this Code, the territorial election commission shall make a decision to recognize the election as failed and to call repeat elections of the village, settlement, or city mayor.
