Despite the seemingly uncontrollable deterioration of the security situation in the country, the Venice Commission has been informed that the Transitional Presidential Council intends to hold presidential and parliamentary elections in February 2026, in line with its – non-renewable – mandate. It has thus been decided that a constitutional referendum will be organised at the end of March 2025. While it belongs to the authorities of Haiti to decide the timeframe of the constitutional reform, the Commission finds the planned pace of the process surprisingly fast. While in a situation of constitutional and security crisis, such as the situation in Haiti, a balance needs to be found between security and inclusive participation in the elections, the Commission does not find it realistic to expect that an even minimum level of security may be expected to be achieved in Haiti in the short term. The incontestable priority of the government of Haiti should be the restoration of security and the provision of minimum vital supplies and conditions to the Haitian people. Envisaging the holding of a constitutional referendum in four months appears moot.
