As concerns the electoral rules, in the current situation, with no elected institution in office, the issue of stability of electoral law does not arise as such. However, it seems appropriate to take the 2021 decree or the legislation applied to the latest elections as a point of departure for the next constitutional referendum and elections. Furthermore, the Venice Commission recommends adding to the revised or new Constitution a transitional provision expressly giving to the transitional executive the power to adopt the necessary electoral rules for the organisation of the first presidential and parliamentary elections. Venice Commission further recommends, in order to ensure the stability of electoral law and of the electoral institutions, to enshrine in the future Constitution the main features of the electoral system and of the electoral administration.
